Overview:

 

The New Fair Lending Examination Procedures

The Federal Financial Institutions Examination Council (FFIEC) released its new uniform fair lending examination procedures in January of 1999. These procedures are used by all FFIEC member agencies - OCC, FDIC, the Fed, and OTS - in their examinations for compliance with the board, nondiscriminatory requirements of the Equal Credit Opportunity Act and the Fair Housing Act. The focus of the procedures is to determine if there are disparities in the application of lending policies between different groups. Because of these examination procedures, the regulatory agencies have strengthened their determination that discrimination, intentional or not, will not be tolerated. The procedures allow banks to self-assess their application of credit policies to all applicants and to ensure that credit policies are applied in the same way to all applicants, regardless of race, color, sex, income, religion, national origin, or marital status.
